Bruno Pereira and Dom Phillips: STJ maintains decision that removes accused from the Jury Court

The minister Ribeiro Dantasdo Superior Court of Justice (STJ), denied not saturday (13) appeal presented by the Federal Public Ministry (MPF) against the fisherman Oseney da Costa de Oliveira. He was accused of involvement in the case of the indigenous man’s death Bruno Pereira and the journalist Dom Phillipsin the Vale do Javari region, in Amazonas, in June 2022.

In his decision, the judge confirmed the understanding of the Regional Court of the 1st Region (TRF-1) about what there is not enough evidence to demonstrate the fisherman’s participation in the episode.

“It appears that the pronouncement sentence was based on an essentially indirect set of evidence”, stated the minister.

In this way, the fisherman’s judgment is prevented from being sent to the Jury Court. However, if an appeal is lodged against the minister’s decision, the case can be analyzed by a panel of the STJ.

In a statement, the fisherman’s defense said that the judge’s decision “preserves constitutional guarantees” and “reaffirms that criminal liability must be individualized”.

“Cases of great repercussion require even more prudence, serenity and technical rigor. The seriousness of the facts is indisputable, but no one can be taken to the Jury Court without concrete evidence of authorship or participation”, said lawyer Lucas Sá Souza, defending the fisherman.
