The Superior Electoral Court () responded to the request and ordered the removal of a publication that used a false image, produced with the “deep fake” technique, which associated the pre-candidate for president (PL-RJ) with the banker Daniel Vorcaro, owner of Master.
The decision was made by Minister André Mendonça. The fake content showed an alleged leaked photo of a private political meeting that never took place.
This is the TSE’s first decision for the 2026 elections involving a “deep fake” image, a technique that uses .
“Freedom of expression does not protect, in principle, the dissemination of manipulated or digitally manufactured content when presented to the public as if it were an authentic record of a real fact,” said Mendonça in his decision.
The minister added that the image was not released as satire, humorous montage or fictional content, hypotheses in which it could be broadcast.
In the action, the PL presented a technical report that indicates a 78% probability that the image was generated by AI.
“There are sufficient elements to recognize, in summary judgment, that the contested publication promotes electoral disinformation through the use of fabricated or manipulated content, with the potential to mislead voters about a politically relevant fact,” stated Mendonça.
The person responsible for publication, Ricardo Pereira, must remove the content within 24 hours and is prohibited from republishing or promoting similar material, under penalty of fine.
The main presidential campaigns have called the TSE in record numbers to remove content from the air, much of it due to misuse of AI.
At the beginning of the year, the electoral court issued a resolution accepting the use of in the campaign, as long as it is properly identified and does not contain malicious content.
