Bill 558/26 guarantees elderly people the right to material equality of conditions in assessments and professional qualification processes, including those required for the exercise of regulated professions. The text under analysis in the Chamber of Deputies changes the Elderly Persons Statute.
The proposal considers reasonable adaptation to be any necessary and appropriate modification or adjustment that does not place a disproportionate or undue burden on the bank.
Unprivileged
“The project does not create privileges or change technical evaluation criteria, it simply recognizes the possibility of reasonable adaptation”says the deputy (Republicanos-DF).
According to the proposal, the adaptation may include adjustments to the time, methodology, method of application or organization of the exam. These adjustments cannot compromise equality, legal certainty or the level of technical demands of the assessment.
According to Julio Cesar Ribeiro, the longevity and participation of people over 60 years of age in the job market have led an increasing number of elderly citizens to seek new certifications, requalifications and professional qualifications.
Next steps
The project will be analyzed in conclusive character by the committees for the Defense of the Rights of the Elderly; and Constitution and Justice and Citizenship. To become law, it will have to be approved by the Chamber and the Senate.
