Case of vaccines: Carmen denies Bolsonaro’s request to nullify investigation

Minister Cármen Lúcia of the Federal Supreme Court (STF) rejected a request from former President Jair Bolsonaro (PL) to nullify the investigation into a fraud scheme in registration on the COVID-19 vaccination card-which culminated in the arrest of the former joint orders Mauro Cid and Bolsonaro’s indictment.

Bolsonaro alleged illegality in the opening of Petition No. 10.405 by Minister Alexandre de Moraes. According to the lawsuit filed by the former president, Moraes would have started a kind of police inquiry through the petition, circumventing the legal rite.

According to Bolsonaro’s defense, “what was filed as ‘petition’ is predominantly a police inquiry triggered by the Hon. Minister Alexandre de Moraes ”, who presents the“ determination that ‘investigations should be conducted by Federal Delegate Fábio Alvarez Shoor, police authority designated to act in these records ”.

The lawyers also questioned the impartiality of the minister, who accumulates the rapporteur of other cases that gave rise to the petition.

In the decision of Thursday (30), however, Minister Carmén Lúcia argued that the defense of the former president did not respect the period of 120 days (from the allegedly arbitrary act of the magistrate) to request a writ of mandamus with Court.

Also according to the minister, the defense of the former president was not able to prove the unlawful act committed by Moraes.

“The authorizing legal requirements of this impetus, in the wake of the consolidated jurisprudence of this Supreme Court, I reject the present writ of mandamus“Decided Cármen Lúcia.

The Federal Police (PF) survey on the case points to the action of one in the Ministry of Health system for several people, including the former president and his daughter.
