Opposition wants spending on security in states outside the fiscal ceiling

As a reaction to the Public Security PEC, the opposition intends to file a bill that toughens criminal legislation and alleviates state spending on security

The opposition to the government of (PT) wants to submit to Congress a proposal that toughens criminal legislation and removes state spending on public security from the limitations imposed by the rules of the Fiscal Responsibility Law (Complementary Law), as stated by the senator (PL-RJ ) in this 3ª fair (12.nov.2024).

Flávio met in Brasília with the governor of Rio de Janeiro, (PL-RJ), and with the president of the Senate, (PSD-MG).

This is a reaction to the PEC (Public Security Proposal) of public security, by Ricardo Lewandowski’s Ministry of Justice, and the ADPF (Argument of Non-compliance with Fundamental Precept) , issued by the STF (Supreme Federal Court). The latter has restricted police actions in favelas in the State of Rio de Janeiro since June 2020 – the trial of the measure will begin on the 4thª fair (13.nov) by the Supreme Court.

According to Flávio, the project, which will not be authored by an individual, but by the Senate Public Committee, in order to speed up its processing, will have 5 aspects:

  • changes the criteria for criminal recidivism to mitigate the possibility of criminals committing crimes again;
  • revises sentence progression criteria;
  • changes the framing of the concept of criminal organization;
  • toughens penalties for criminals caught using assault rifles; and
  • removes state spending on security from the Fiscal Responsibility Law.

Regarding this last point, Governor Cláudio Castro stated that it is necessary to delink spending so that the allocation of resources in the area of ​​public security “do not compete with education, health and science and technology”.

For Castro, the State of Rio de Janeiro is experiencing a “perfect storm” caused, above all, by ADPF 635. “The false sense of reduced lethality brings a high cost to the population of Rio de Janeiro”, he declared.

The governor also endorsed the proposal for a “big correction” in criminal legislation. “There is a clear disagreement between the legislation and the current situation. Current legislation is an incentive to crime. The police arrest, the courts release”.
