Senator files PEC to end parliamentary committee amendments

The Proposed Amendment to the Constitution (PEC) 43/2024, which establishes the end of committee amendments, was filed in the Federal Senate, this Wednesday (13). The text was authored by the senator Alessandro Vieira (MDB-SE).

The text, which reached 27 signatures from parliamentarians to begin processing in the legislative house, seeks to attack an alleged distortion caused in recent budgetary processes in which amendments indicated by committees acquired an increasing share in the public budget without guaranteeing proportionality between parliamentarians in distributions opaque.

In the justification that accompanies the article, Vieira maintains that the committee amendments were constructed as “important legislative decision-making tools on public policies”, but that recently they would have been used as a mere instrument to replace the rapporteur’s extinct amendments — the so-called “secret budget ”, declared unconstitutional by the Federal Supreme Court (STF).

According to the parliamentarian’s office, the project seeks to “guarantee more transparency and equality in the execution and distribution of parliamentary amendments” and is a “response to the need to correct abuses in the use of public resources and the lack of clarity in decisions that impact the allocation of funds”.

According to Vieira, the committee amendments became a “hidden version of the secret budget”, with a large concentration of resources and a distribution without technical criteria or traceability.

“These are amounts ​distributed between commissions in a manner that is not equal or supported by any technical basis, and distributed according to ‘indications​’​ of which the origin is not known”, states the Emedebista senator.

“In short, it is a poorly disguised version of the secret budget that was already declared unconstitutional. Our proposal cuts to the heart: the pure and simple extinction of committee amendments, determining in the Federal Constitution that the types of amendment on merit are exclusively two: individual and state bench”, explains Vieira.

According to the text of the PEC, the amount of committee amendments must be redistributed between individual and bench amendments, respecting the proportions between the modalities and between the amount reserved for senators and deputies.

Also according to the PEC, it is mandatory to disclose, by electronic means, the body executing the amendment and the objective and impersonal criteria for distribution among the beneficiaries of the resources.

The implementation of the amendments must also take into account socioeconomic indicators of the beneficiary population and criteria related to good financial management.

“The main focus has to be the citizen and meeting the main needs of Brazilian society”, concludes Vieira.
