Even after a favorable decision from the STF, the units should be implemented in 2025 and start operating only in 2026
The São Paulo government decided to extend the public consultation on civic-military schools until 2025. The choice postpones the original plan to implement 45 units next year. According to the new schedule, schools should start operating in 2026.
That’s 3th fair (26.nov.2024)Minister Gilmar Mendes, of the (Federal Supreme Court), overturned the decision of the (São Paulo Court of Justice) that prevented the implementation of civic-military schools in the State.
The decision was in response to a request from the governor (Republicans), petitioned and forwarded to the minister on the 2ndth fair (25.nov).
The decision revoked the injunction of judge Luiz Antonio Figueiredo Gonçalves, who had suspended the model in August 2024. Mendes’ decision, however, does not concern the constitutionality of the law that establishes the model of civic-military schools and will be analyzed by the plenary of the Court.
CIVIC-MILTARIAN SCHOOLS
Civic-military schools gained more visibility and strength during the government of the former president (PL).
In mid-July 2023, the government of (PT) issued Federal Decree nº, which established the National Program for Civic-Military Schools. However, the program was recovered in the National Congress by the federal deputy (PL-AM).
The project that establishes the model in the territory of São Paulo was approved by 54 votes in favor and 21 against, at the (Legislative Assembly of the State of São Paulo), in May 2024. On the day of the session, high school students protested against the measure and were attacked by the Military Police.
In October this year, the STF to debate the subject, giving space for teachers, education specialists, jurists, parliamentarians, authorities and representatives of public bodies and civil society entities to present arguments for and against the project.
