Last Wednesday (27), and recalled that van Hattem, as a deputy, has the right to parliamentary immunity and cannot be punished due to his opinions.
The Federal Supreme Court has also recognized on yet another occasion that this prerogative is absolute.
“It is absurd for the Federal Police to mobilize a structure to try to punish me for a critical opinion, given that the STF’s jurisprudence is clear about protecting parliamentary prerogatives”, says van Hattem.
Furthermore, the deputy intends to question the Minister of Justice, Ricardo Lewandowski, on the topic, during a public hearing at the Chamber’s Public Security Committee, next Tuesday (3) – the PF is subordinate to the department.
The investigation against Martins has been criticized by Bolsonaro supporters due to inconsistencies regarding his supposed trip to the USA at the end of the Jair Bolsonaro government, in 2022.
The trip was used to justify the former advisor’s imprisonment for six months, as there would be a risk of escape. Martins, however, presented evidence that he did not leave Brazil during the period and was released by Minister Alexandre de Moraes, of the Federal Supreme Court.
