The National Electric Energy Agency (Aneel) approved this Tuesday (11) changes to the rules for commercialization of electricity in the free market. The directors consolidated contributions received in public consultation.
Now, distributors must send their customers’ measurement data daily and, if they fail to comply with the migration deadlines, they will be forced to compensate consumers.
More than 21 thousand customers began to operate in the free contracting environment (ACL) until October 2024. With the new rules, simplified migrations, which constitute a large part of this total, will be able to participate in the demand response program, in which they are remunerated by reducing energy consumption during times of high demand.
Aneel also determined that debt settlement is mandatory in the event of a change of supplier.
Standard contract
Another requirement approved by the agency concerns the publication, on each supplier’s website, of a standard contract model. This will make it possible to have more transparency and ease of comparison between the elements of retail contracts.

Previously, consumers themselves were responsible for the information provided to the Electric Energy Trading Chamber (CCEE). The Brazilian Association of Electric Energy Traders (Abraceel) considered the changes positive.
“As important as the ratified advances is the decision to study and discuss a new round of measures to modernize, simplify and improve stages of the migration journey to the free energy market”, stated the president of Abraceel, Rodrigo Ferreira.

The entity also demands a more explicit prohibition on the sharing of customer data from distributors to traders in their own economic groups. Furthermore, suppliers are asking for a reduction in the time taken to send measurement data by distributors.
