General Braga Netto’s defense asked Minister Alexandre de Moraes, of the Federal Supreme Court (STF), to reconsider the soldier’s arrest. Lawyers ask for an alternative and justify that the former minister has no history of disobedience.
“General Netto is a retired soldier, with no history of disobeying court orders or conduct that justifies the adoption of such a severe measure. Furthermore, there is no concrete indication that he poses a risk to public order, the application of criminal law or that he compromises investigations that have already been completed”, argues the defense.
Former government minister Jair Bolsonaro (PL) has been in prison since Saturday (14). The arrest took place as part of investigations investigating an attempted coup after the 2022 election.
. He would have tried to obtain data from the plea bargain of Lieutenant Colonel Mauro Cid, Bolsonaro’s former aide-de-camp.
In the decision that determined the arrest, Moraes stated that the developments of the investigation revealed Braga Netto’s “true leadership, organization and financing role” in the coup plans.
In a statement on February 5, 2024, Mauro Cid confirmed that Braga Netto and “other intermediaries” contacted his father, General Mauro Lourena Cid, by telephone to find out information about the award-winning collaboration.
Preventive detention is a precautionary measure decreed by the Court during the investigation phase or during the course of a criminal proceeding, to ensure the regular progress of investigations and avoid harm to the case. The modality prevents the accused from committing new crimes or harming the progress of the process, destroying evidence, threatening witnesses or fleeing.
In this case, the Federal Police argued that the colonel’s freedom could represent, as he would be able to commit new acts that could interfere with the investigation.
Braga Netto served as Minister of the Civil House and Defense in the Bolsonaro government. In 2022, he was a candidate for vice-president on the ticket of the former president who was seeking re-election.
