AGU understands that Dino’s decision maintains a blockade of R$ 4.2 billion in commission amendments

A Attorney General of the Union (AGU) published this Monday, 30, a opinion to guide the Executive on the application of the Federal Supreme Court (STF), regarding the committee amendments not value of R$4.2 billion which were suspended by the minister. In the opinion, the body argued that the minister’s decision, published on Sunday, 29, maintains full lock of these values.

The execution of these amendments was suspended on December 23, after the PSOL pointed out irregularities in the letter signed by 17 party leaders that changed the allocation of commission amendment funds of R$4.2 billion.

The Chamber filed an appeal and argued that the amendments were duly approved and Dino published a new decision on Sunday (29), to release part of the amendments of commission.

According to the AGU, Dino’s decision released the transfers relating to the commission amendments committed by December 23rd and which are not the subject of the questioned letter. The AGU instructed the Executive to adopt the safer interpretation of the decisioni.e, not authorize transfers of this letter until further court decisioneven if they were committed before the 23rd and are intended for the health sector.

The interpretation of the body that is the legal arm of the Executive, starts from the section of the decision in which Dino declares the “insurmountable nullity” of the Chamber’s letter and determines that “its acceptance and follow-up is unfeasible, so that the Executive Branch is definitively prohibited from committing what is there.”

After this part of the decision, Dino made a caveat in relation to the amounts committed before the suspension of the effects of the letter, on December 23rd.

The AGU, however, sees a “reasonable doubt” as to whether this reservation reaches the committee amendments that are the subject of the letter.

“Despite the reasonable doubtit appears, at this moment, prudent to adopt the safest interpretation of the decision, in the sense that, at least until further judicial clarification, the commitments of the commission amendments object of Letter no. 1.4335.458/2024, even if prior to 12/23/2024 and even if intended for health”, says the AGU opinion.

In relation to resources allocated to health (of all types of parliamentary amendments) already deposited in the Health Funds, the AGU understands that Dino’s decision authorizes the movement of resources until January 10, 2025. According to the decision, from the 11th there cannot be any movement, except from the specific accounts for each parliamentary amendment.
