AGU asks Dino to release payment for health amendments

Federal government body asked the STF minister for clarification on the decision that released pledged amounts

The AGU (General Attorney’s Office of the Union) asked, on the evening of this Monday (Dec 30, 2024), clarifications to the minister of the STF (Supreme Federal Court) Flávio Dino about his decision that. The body also asked that at least the resources allocated to health be released to guarantee the “constitutional minimum” to the area.

In Sunday’s decision (Dec 29), Dino stated that there is a “insane nullity” of the letter questioned in the STF, but made an exception for the payment of commission amendments that had already been committed by December 23rd. According to the agency, The extent of this reservation was not clear.therefore, is now questioning whether or not the committee amendments contained in the letter were released.

“This is the aspect of obscurity that deserves clarification, because there is reasonable doubt regarding the decisional message extractable from different points of the decision […] It is necessary to clarify that the extension of the reservations provided for in items 16 and 19.a) must also include the committee amendments that have been the subject of Official Letter No. 1.4335.458/2024, especially those aimed at health”writes AGU in the petition.

In a subsidiary request, the AGU requests the “exceptional validity” commitments for committee amendments aimed at health that have been carried out by December 23, even if they are the subject of letters nº 1.4335.458/2024, from the Chamber, and nº 220/2024, from the Federal Senate.

According to the AGU, this would be a measure aimed at “strict compliance with the duty to guarantee the constitutional minimum in health” and conditioned on subsequent validation of the nominations in specific minutes, with identification of the requesting congressmen.

UNDERSTAND THE CASE

The AGU’s request to the STF comes after one with guidance to the government on the execution of amendments, based on a previous decision by Dino that released part of the amendments that were blocked by the minister’s own decision, as long as they were already committed on December 23rd.

In the opinion, the AGU defends that the “safer interpretation” of Dino’s decision, and advised that R$4.2 billion remain blocked.
