According to the Court, the man was “impaired by the use of various drugs”; the accident occurred in December 2024
This Tuesday (21 January 2025), in Espírito Santo, he arrested the driver of the trailer involved in the accident with a bus and a car on December 21, 2024 in Teófilo Otoni (MG).
The man’s arrest was ordered by judge Danilo de Mello Ferraz, from the 1st Criminal Court of the District of Teófilo Otoni. According to the magistrate, the driver was “driven by the use of various drugs”. Here is the statement (PDF – 1 MB).
It was concluded that there was dolo eventual since the driver took risks. The judge decided to review the probation after “new elements” arise during investigations, such as:
- absence of the driver at the scene of the accident;
- overweight of the trailer load (68 tonsbut the trailer had maximum capacity for 30 tons);
- speeding (I was 90 km/habove the 80 km/h allowed);
- exhausting travel journey and lack of adequate rest; and
- use of narcotic substances.
According to the judge, it was not a “simple carelessness or failure to observe a duty of objective care, but in deliberate assumption of risk”.
The one about the prison was made by the governor (Novo) on X (former Twitter). “Using high technology, the investigation showed that the driver was under the influence of illicit substances. In Minas, there is no impunity!”he wrote.
THE ACCIDENT
At the time, the Minas Fire Department reported that a bus from the company Entram, which was transporting 45 passengers from São Paulo to Jequié (BA), entered the wrong lane of BR-116 and collided with a trailer carrying a load of stones.
A car coming behind hit the bus. Moments later, the bus caught fire.
