Former SEF director protected inspectors who killed the Ukrainian. He was sentenced this Friday to two and a half years in prison with a suspended sentence, two security guards to 6 months suspended sentence. Two other inspectors acquitted.
The defense of the director of Borders of Lisbon at the time of Ihor Homeniuk’s death in SEF custody, in 2020, will appeal the suspended sentence of two and a half years in prison to which António Sérgio Henriques was sentenced.
The lawyer, Filipa Correia Pinto, added that she detected “several inaccuracies” in the decision read for almost three hours by judge Hortense Marques.
The former Director of Borders of Lisbon of the extinct Foreigners and Borders Service (SEF) was convicted of a crime of denial of justice and malfeasance.
The court found that, in 2020, Antonio Sérgio Henriques omitted information about what happened to the national management of the SEF, to protect the three inspectors who, in 2021, would unintentionally kill the Ukrainian citizen from disciplinary proceedings.
Ihor Homeniuk, 40, on March 12, 2020, after being beaten and left lying and handcuffed by the three inspectors, for eight hours and without supervision, in a room in the Space Equipped with a Temporary Installation Center (EECIT) at Humberto Delgado Airport, in Lisbon.
This Friday, in the second process of the case, the Lisbon Local Criminal Court acquitted two other inspectorsaccused of the crime of negligent homicide by omission, and sentenced two EECIT security guards to a six-month suspended sentence for illegally carrying out private security activities.
“I leave this trial with the sincere perception that justice has been done”, reacted the representative of the Ukrainian citizen’s family, José Gaspar Schwalbach, predicting that the sentence will be “the final point” that will allow Ihor Homeniuk’s wife and daughters to make “the mourning of the whole situation”.
