Chapecoense obtained a favorable demonstration of the MP-SC (Ministry of Public of Santa Catarina) to the new proposal presented by the club to pay off the remaining balance of its debt listed in the judicial recovery process.

According to an order signed by prosecutor Fabiano David Baldissarelli on January 29 this year, the association proposes to pay the debts “in a single installment, provided that it is applied to the remaining balance to be paid for the 70%”.

In practice, Chapecoense asks for a new discount beyond that obtained when the court approved the judicial recovery process. At the time, the club’s debt was estimated at $ 224 million, but the team leaders got an 85% discount of that amount, which fell to $ 33.6 million.

Now the association claims a new reduction on the current balance of its debt. In case of acceptance by all creditors, the debt would fall to about $ 10 million.

Family members of the 71 victims of the 2016 air disaster are on the list of creditors of the Santa Catarina team. In the judicial recovery process, the proposal presented was to pay compensation within 13 years.

In the order of the 5th Prosecutor of Chapecó District, the prosecutor accepted the argument of the lawyers for the new form of payment, because, “at first, the proposal will not cause losses to the creditors because it has no imposing character but optional. “

“It is not a binding proposal but an option for those who want to receive faster. Fifteenth place in the last edition of Serie B of the Brazilian Championship, the Santa Catarina team cites in their proposal the celebration of the recent contract for the sale of part of the club’s commercial rights related to the Brazilian Championship, Series A and B, in the period between 2025 and 2074.

The agreement is described in the club’s lawyers’ petition as a “recent capital injection”, with which “it was concluded that Chapecoense would propose to all its competition creditors, regardless of the classification of its credits, Possibility of receiving the ‘remaining balances’ of these, still pending payment, in advance and in a single portion “.

Also according to Felipe Lollato, after receiving favorable demonstrations of the MP and the judicial administration, Chapecoense now awaits the decision of the Judge of the Regional Court of Bankruptcy and Judicial and Extrajudicial Recovery of the Concordia SC District.

There is no definite deadline for the judge’s decision, but club representatives say that in these cases the judge is often fast.
