Minister Alexandre de Moraes, from (Supreme Federal Court), referred on Saturday (8) to the PGR (Attorney General’s Office) the defenses of the former president, the former minister and 18 other reported for attempted coup.
Now, Attorney General Paulo Gonet will have five days to comment on the documents presented and arguments of the accused. The deadline starts on Monday (10) and ends on Friday (14).
Bolsonaro and 33 others in February for allegedly planning and trying to execute a coup after defeat in the 2022 elections for President Luiz Inacio Lula da Silva (PT).
The PGR says that the former president edited a coup draft, sought support from the armed forces chiefs to the conspiracy, ancoured with a plan to kill the minister and was one of those responsible for attacks on the three powers on January 8, 2023.
Bolsonaro was denounced for the crimes of attempted violent abolition of the Democratic Rule of Law and coup d’état, damage qualified by violence and serious threat against the union’s assets, deterioration of overturned assets and participation in a criminal organization.
In (6), the former president’s lawyers deny that he has participated in an attempted coup and claim that the complaint stacked narratives with contradictory coup plans and does not present concrete elements to support the accusations.
Moraes also referred to the PGR the defenses presented by Braga Netto, the former Justice Minister, the former director general of ABIN (Brazilian Intelligence Agency) and current federal deputy, as well as other accused.
There are still other complaints whose deadline for presentation of the defense did not expire and only then will have the documents sent to the Attorney. This is one of the stages of the preliminary phase of the process, where the first class of the Supreme Court will decide whether or not to accept the complaint and make defendants the accused.
