The measure was granted with provisional urgent protection. The judge considered that there is “abundant evidence” of the persecution suffered by Vladimir Herzog and highlighted the state of Clarice, who is 83 years old and in an advanced phase.

The amount of the pension was calculated based on the position held by Vladimir Herzog at the time of his death, director of the Journalism Department of TV Cultura. According to the court decision, the amount can still be reevaluated during the process.

Vladimir Herzog was summoned by the army to give testimony about his calls with the PCB (Brazilian Communist Party). On October 25, 1975, he attended Doi-Codi and was never seen with life again.

The official version released by the military claimed that the journalist would have committed suicide inside the cell. However, later reports and investigations proved that he was tortured and murdered by the regime.

In 2013, the São Paulo Court ordered the rectification of the cause of death in Vladimir Herzog’s death certificate. The new version replaced “mechanical asphyxiation with hanging” with “lesions and mistreatment suffered during interrogation in dependence on the 2nd Army (DOI-CODI)”.

In April last year, the Amnesty Commission acknowledged that Clarice Herzog was also persecuted by the Brazilian state due to her struggle for justice after her husband’s death. The collegiate determined that she is entitled to economic reparation, to be paid by the Ministry of Planning.
