The first class of the (Supreme Federal Court) begins on Wednesday (26) to reap the votes that will define if the former president () will be made a defendant in the case of the 2022 coup plot. It will be the resumption of the trial started on Tuesday (25), when the collegiate unanimously denied the procedural issues presented by the defenses.

The expectation in the Supreme is that the complaint will also be received unanimously by the rapporteur of the case, minister, and by the other members of the board ,,, and.

From now on, the magistrates vote for the strength of the complaint, that is, if it has evidence of materiality and authorship against each of the accused. Thus, the ministers will need to assess whether the PGR (Attorney General of the Republic) piece supports themselves enough to be able to make the accused respond to criminal proceedings.

To date, there was no formal manifestation of the ministers about the merits of the prosecution. Moraes, however, made some statements about the case, as when he said he had or that a “totally untruth” narrative was needed around the subject.

“A narrative was created, just like the flat land, that the STF would be condemning ‘old ladies with the Bible in hand’, which would be walking a sunny Sunday, the National Congress and the Planalto Palace,” the minister said on Tuesday.

The ministers denied five preliminaries presented by the accused’s lawyers, such as the request for nullity of the award -winning collaboration and the case to the Supreme Plenary – the minister was overcome at this point.

Bolsonaro was the only one of the accused to accompany the trial in person. He sat in the front row in the central area of the plenary.

On the first day of the session, two points generated controversy among ministers. The main one refers to the validity of the award-winning collaboration of Lieutenant Colonel Mauro Cid —o.

The defenses argued that Cid lied, omitted and contradicted. They also pointed out problems in conducting collaboration, such as the fact that the agreement was signed with the Federal Police without consent with the Public Prosecution Service, or that Cid “broke with the agreement when he leaked the denunciation [como] Veja magazine came out, “as Bolsonaro’s lawyer Celso Vilardi said.

Minister Luiz Fux was the first to present disagreements from the rapporteur. At one point, he diverged from Moraes by accepting the preliminary defenses about the appropriate forum to process the case. For the minister, the Supreme is not the proper environment for the process. He has a more restricted understanding of the forum prerogative.

Being in court, in his view, the case should be analyzed by the full plenary.

Later, about the controversy of the validity of the agreement of Mauro Cid, Fux demonstrated new spread, even though he accompanied his colleagues in the vote. “This is not the proper moment, but I see with a lot of reserve nine allegations of the same collaborator, every hour showing a novelty.”

In addition to the accusation against Bolsonaro, complaints against seven other members of what PGR classified as a central nucleus in the articulation of an institutional rupture to prevent Lula (PT) in the 2022 presidential elections prevent the possession of Lula (PT).

There are the federal deputy for the PL and former chief of Abin (Brazilian Intelligence Agency); former Navy commander Almir Garnier; former Justice Minister Anderson Torres; former Institutional Security Office Minister Augusto Heleno; The former Assistant of Bolsonaro Orders Mauro Cid; Former Defense Minister Paulo Sérgio Nogueira; and the former minister of the Civil House and Defense.

They are accused of attempted violent abolition of the Democratic Rule of Law and coup d’état, as well as damage qualified by violence and serious threat against the union’s assets, the deterioration of listed assets and participation in a criminal organization.

If the ministers decide to open criminal proceedings, the case must be tried later this year. If convicted, the defendants can take feathers that exceed 40 years in prison.
