The Espírito Santo Court of Auditors (ESC-ES) has created an extra payment for counselors and attorneys-equivalent to about 30% of their salaries-and placed administrative proceedings to grant these under confidentiality.
In a decision of the end of January, the agency, which has the function of overseeing the State’s public accounts, determined that its members are entitled to compensation equivalent to ten days of work by “accumulation of collection”.
The expression means dealing with an excessive volume of processes. Extra work is rewarded with clearances, converted to cash – can exceed $ 10,000.
According to the resolution that created the benefit, the new payment was based on an identical penduricor created last year by the Court of Justice of Espírito Santo and another established in 2023 in the State Public Prosecution Service.
The criterion that the accounts of accounts established to characterize the accumulation of the collection was to verify that the total of processes received in the year was 50% or greater than the average of the previous three years.
Thus, in practice, the counselor who had to deal with this year, less than half the number of processes he had in the last three years.
The TCE-ES has seven accounts of accounts, three substitute advisers and three accounts, with gross wages ranging from $ 36,000 to $ 42,000.
Last month, the president of the agency, Domingos Augusto Taufner, received payment of R $ 92.8 thousand. In all paychecks of the last 12 months he received salaries higher than the ceiling of the civil service, which is currently R $ 46,300.
To have access to the new benefit, each counselor had to open an internal administrative process at TCE-ES. The agency decided to maintain these procedures under confidential. THE Sheet He asked what motivated the decision not to make these processes public, but got no answer.
The report also questioned what were the parameters used to determine that the criterion for granting the hanging was the fall in the number of processes compared to previous years. The press office of the agency did not respond.
Courts of justice from all over the country have been paying supersalaries to their members in the face of understanding of the (National Council of Justice) and the (Supreme Federal Court) of Brazilian functionalism.
State Public Prosecution Service and Public Defenders have used these decisions as a reference, sometimes through associations that lobby for these categories.
Courts of Auditors are linked to the Legislative Power, but the counselors have followed the practice of legal careers. According to a survey by the NGO know, specializing in public data transparency, between the 27 state and Federal District Courts, 13 paid supersalaries to their members in 2024.
