The federal deputy Duda Salabert (PDT-MG) filed a bill on Monday (31) that prevents the granting of amnesty to investigated or convicted of coup d’état. The proposal amends the Penal Code to establish that this type of pardon does not apply to crimes against democratic institutions.
The initiative arises amid the amnesty PL, stopped in the House since last year, which intends to forgive those involved in the attacks on the headquarters of the three powers in Brasilia, in January 2023.
“The preservation of democratic institutions and the guarantee of fundamental rights require measures that prevent the impunity of acts that undermine the constitutional order and the legitimate functioning of the powers of the State,” says Salabert’s text.
“The granting of amnesty to individuals involved in such crimes would be incompatible with constitutional principles and would weaken the mechanisms of protection of democracy,” adds the deputy.
The project needs to be analyzed by the chamber’s thematic committees before going to the plenary vote.
