Virtual Session of the 1st Class will be on May 9; defense disputes images shown in the trial that accepted the complaint for attempted coup
The 1st Panel of the (Supreme Federal Court) marked the judgment of the defense of General Walter Braga Netto to the defense of receipt of the complaint for attempted coup. The collegiate will analyze the case at a virtual plenary session that will extend until May 16.
In the appeal, the lawyers question the video aired by Minister Alexandre de Moraes during the trial that welcomed the prosecution. The material showed the invasion of the Praça dos Três Powers on January 8, as well as images of the attempt of (Federal Police) in Brasilia on December 12, 2022 and the bomb at the federal capital airport on Christmas Eve of the same year.
According to the defense of the former minister of (PL), the material “It goes beyond the limits of the accusatory narrative”because it brings facts that are not part of the PGR complaint. Lawyers ask that the reference to the video is taken from, because they should be considered “Illicit evidence”.
On Thursday (24.ab.2025), the PGR spoke against the appeal. The Attorney General of the Republic, Paulo Gonet, said that the accusatory narrative worked with events from 2021 to 2023 and that, for this reason, there was no violation of the prosecution’s principles by displaying the video. “The accusatory narrative contained in the complaint was not restricted to the date of 8.Jan.2023, having, on the other hand, expanded from at least 29.jun.2021 to 8.Jan.2023. Thus, there is no need to be considered violation of the prosecution system in the use of the complaint, images related to events recorded in 12.2024 and 24.2024.2024”disse Gonet.
The type of appeal presented is a declaration embargo. The instrument is used to state that there is an omission in a decision and request the clarification of some points.
In addition to the video, Braga Netto’s defense also cites other points previously presented as preliminary arguments against receipt of the complaint, as a request to nullify the denunciation of Lieutenant Colonel Mauro Cid and the request for access to the full evidence gathered by the investigation.
Gonet also spoke out against the allegation of omission and to reject the embargoes. The board has already denied these points and must keep the decision.
