SP will indemnify companies at R $ 335 million per monorail – 15/05/2025 – Panel

The government of Sao Paulo filed an agreement with the concessionaire that had the CE contract will pay R $ 335.4 million to end an arbitration dispute that has been dragging since 2023.

That year, the concessionaire, consisting of the companies Come ABC – Primav Infrastructure, Cowan, Call, Igli do Brasil and Benito Roggio Transporte, requested compensation of R $ 2.4 billion to the state.

The consortium argued that it was injured by a decision made in 2020, during the João Doria management. At the time, the state government extinguished the concession agreement, which had been signed in 2014, with argument of unfeasibility of execution of the line project, which would go to the ABC region. The project to this day has not left the paper.

The indemnity agreement, made through the Secretariat of Partnerships in Investments (SPI), was published on Thursday (15) in the State Official Gazette and ends the dispute.

According to the agreement it is advantageous for the state, since there was a 86% reduction in the value of the initial compensation requested by the company.

Other highlights are that the hit avoids higher convictions, eliminates judicialization costs, reduces a complex liability and brings fiscal predictability.

“With this, the government of São Paulo reinforces its proactive stance in the management of contractual crises and reaffirms its commitment to legal certainty, transparency and attraction of investments in infrastructure,” he says.
