The Minas Gerais Court of Justice ordered the suspension that auctioned four hydroelectric plants for amber, the group’s energy arm, brothers and Wesley Batista
The event took place in December last year, when the amber finished for R $ 52 million Marmelos plants in Juiz de Fora, Martins in Uberlândia, sincerity, Manhuaçu and the SMP (small hydroelectric plant) Machado Mineiro, in red water.
The decision of Judge of the 1st Court of Public Finance and Municipalities of Belo Horizonte last Thursday (15) accepted the argument that the auction of these assets represented marketing of part of the company and, therefore, would need to be approved by the Legislative Assembly and pass through popular referendum, as provided for in the state constitution.
Sought, Cemig said it will appeal the decision and that the sale of the plants was motivated by technical and economic and financial analysis.
“The company stresses that it is not reducing its structure, on the contrary, the resources acquired by selling small hydroelectric dams are being reinvested in larger, more efficient and energy transition,” the company said in a statement.
Cemig has argued in defense of the action that plants are not their subsidiaries, do not have CNPJ and represent only 0.32% of their generation portfolio, which, in the company’s view, deconstructs privatization.
Earlier this year, the TJ-MG had already annulled another notice that auctioned 15 Cemig plants.
The decision, however, was overturned in March because the popular action does not contain the quote to Cemig Generation and Transmission SA and to Horizons Energia SA
The government of (Novo) defends the privatization of CEMIG, but has faced obstacles in the Legislative Assembly.
The new bet of state management was to include privatization – and subsequent federalization – amid the $ 168 billion that the state has with the Union.
