Germany continues to reject migrants despite the decision of the court

The German government said on Monday that it will continue to policy refusal to asylum applicants at the country’s border. She responded to the decision of the court in Berlin, which described this step as illegal, TASR reports according to the AFP report.

The government took anti -migration measures on 7 May, the day after the boarding of the office of Friedrich Merza. The German Interior Minister Alexander Dobrindt subsequently sent an instructions to the federal police to reject asylum seekers on the German border. Exceptions included vulnerable groups – women at an advanced stage of pregnancy, women with small children and seriously ill.

However, on Monday, the court ruled that the persons, “who, during the border control in Germany’s territory, shall not be interested in submitting an asylum application must not be sent back” until the state is responsible for the processing of their request under the Dublin Agreement.

The Minister insists on rejection

Dobrindt said in a statement that the rejection of migrants would continue. “We think we have legal support for this,” the minister stressed. At the same time, he insisted that Monday’s judgment was only valid for the “individual case” of three Somali citizens.

On Monday, the Berlin Court brought a judgment in favor of three Somalians, whose authorities returned to Poland on 9 May from the border town of Frankfurt nad Oder. According to the court, the authorities should have proceeded in accordance with the European Union under the Dublin Agreement for Asylum Cases. On the basis of the Dublin Agreement, the police cannot reject asylum seekers on the border. The country’s authorities must launch a return process so that they can hand them back to the country where they first entered the EU territory.

The court described the proceedings as illegal

The Berlin Court described the rejection of migrants illegal and stressed that “conclusions can also be applied in other cases”. At the same time, he rejected the government’s argument that the fulfillment of the agreement could be suspended because of the “national emergency situation”. Indicated that there is insufficient evidence of a threat to public security or order.

According to the Court, the Dublin agreement must be applied in any case, although it specified that this decision does not grant migrants permission to join Germany, as the implementation of the appropriate procedure should be possible at the point of crossing the border.
