He answered one of the PGR (Attorney General of the Union) sent to the Court after the deputy who had left Brazil. The congressman went to 10 years in prison for trying to invade the CNJ (National Council of Justice) systems to issue false arrest warrants.

Interpol criteria
Red notifications are published after the judge’s request in cases where the sought after person left the country. In the request, Moraes assumes the commitment and justifies the interest in instructing any extradition request if the fugitive is located and arrested in another country.
All documentation regarding the case is referred to one of the regional representations of the Federal Police, which analyzes the formal aspects of documentation – this is the phase in which Zambelli’s request is.
After the analysis, the documents are sent to the central office of Interpol, a division subordinate to the Federal Police International Cooperation Board, for a 2nd analysis, with the objective of giving formalities and translation of documents into one of the official languages.
The final phase is the sending of documents to Interpol’s headquarters in Lyon, France, electronically. There, the request will undergo a formal analysis and “material”. If it is necessary to complete with more data, Interpol may request clarification. There is no deadline for the whole process to be completed, but it can take a few days.
Brazilians and Interpol
There are other requests sent by Minister Alexandre de Moraes to include Brazilians in the red diffusion of Interpol: Oswaldo Eustáquio and Allan dos Santos.
In the case of Allan dos Santos, Interpol the request and, therefore, he is not considered a fugitive. The organization considered that the reasons presented are insufficient to support the evidence of crimes.
The extradition request to the United States, where the journalist has been living since 2021, has not been answered either. Allan is the target of inquiries (E) in the Supreme Court and had his pre -trial detention determined by Moraes, but has no conviction or was denounced by the prosecutor.
Oswaldo Eustáquio is investigated for his performance in intimidation campaigns against public agents and incitement to extremist acts at the Court. It is in Spain and had its extradition request refused. The country understood that the request for Moraes has a “Political motivation”.
In the case of Zambelli, there is already a conviction. However, the request for arrest is preventive, and does not concern the execution of the sentence, because it is still appealed. For now she is without a lawyer in the case, who renounced after her departure announcement from Brazil. The arrest, therefore, will depend on the evaluation of the foreign country where the congressman is located.
