The Liberal Party (PL), which houses, in others, former President Jair Bolsonaro, filed a lawsuit in the Supreme Court (STF) to question the increase in tax operations tax (IOF) rates announced in May by the federal government. The case was distributed, by draw, to Minister Alexandre de Moraes.

In the action, the PL calls for the injunction of two decrees dealing with the changes in the collection, signed by the President of the Republic, Luiz Inacio Lula da Silva, and the Minister of Finance, Fernando Haddad. The measures changed, among other points, IOF rates in credit operations for companies, international remittances, external investments and various exchange rates.

According to the party, the tax raise was unconstitutional for leading to a deviation of the purpose of the IOF. According to the association, the government adopted the measure to increase the collection, contrary to the extrafiscal nature of the tax. For this increase, the caption says it is necessary law approval, not just decree edition.

“The rules in question propose more than 60% increase in the collection of IOF, which clearly goes beyond the extrafiscal and regulatory nature of this tax,” the party says.

Also according to the PL, “the new system of IOF rates had as its sole purpose to increase the collection. That is, Decrees No. 12.466/2025 and No. 12.467/2025 increased the tax on various operations exclusively due to its tax effects, not extrafiscal”.
