The defense of the federal deputy (PL-SP) prepares for her likely arrest in Italy in the next few hours or days, but says she is confident that she will quickly get a habeas corpus.
“There is a great probability that she is arrested, this can happen at any time. So let’s make an appeal, present a habeas corpus. She has housing in Italy, we believe she will,” says the new lawyer of the parliamentarian, Fábio Pagnozzi, who took her defense last week after Daniel Bialski’s departure from the case.
Zambelli had Opara to serve the penalty that he invaded CNJ (National Council of Justice) systems.
The deputy, according to her lawyer, is in a house in Rome avoiding taking to the streets, but is not hiding from the police.
Zambelli intends to fight extradition, and for that he also hired Italian lawyer Pieremilio Sammarco, specializing in causes.
She would accept to serve a sentence in the European country, according to Pagnozzi, believing it would be better than going to jail in Brazil.

He believes that there is a great chance that extradition is denied by Italian justice, and not just because Zambelli has citizenship from the European country.
“What will tell a lot is the typification of the crime. In her case, it does not seem to be serious enough to be extradited. I do not see precedent for that. But it is a decision that is up to Italian justice, of course,” says the lawyer.
Pagnozzi says he has been talking to Zambelli often and that she feels abandoned by allies.

Another defense strategy is to seek criminal review in the Supreme Court, although the chances of success are considered pcheneous. This instrument is possible when new facts that can change the conviction of judges arises.
What may give rise to this request is the fact that former Defense Minister Paulo Sergio Oliveira of the Jair Bolsonaro government has denied in a statement to the STF this week a meeting with Delgatti. The action should be presented next week.
Zambelli also follows at a distance the decision to authorize his arrest, as the house regiment orders. For this, the vote of 257 deputies is required by chanceling the STF sentence.
At first, he decided only to follow the order of the Supreme Court, declaring the arrest without evaluation of the house.
