The lawyers of the licensed federal deputy Carla Zambelli (PL-SP) presented on Wednesday, 2, the defense of their cassation process. Fábio Phelipe Garcia Pagnozzi and Pedro Paulo Pagnozzi asked, in the document, for the Constitution and Justice Commission (CCJ) to listen to hacker Walter Delgatti Neto, who would have helped Zambelli invade the National Council of Justice (CNJ) system.
“Deputy Zambelli suffered a criminal action, which, in her absence, was based only on the speech of a whistleblower whose credibility is highly questionable. This individual, who has already been qualified as ‘mythomaniac’ and ‘compulsive liar’ by the Federal Police, showed an inability to maintain a cohesive narrative,” the defense says through the document, referring to Delgatti.
Lawyers deny the deputy involvement with the hacker and claim that hearing him is necessary to “settle any contradictions and confront the versions presented.”
In addition to Delgatti, Zambelli’s defense also asks General Paulo Sérgio Nogueira de Oliveira, former Defense Minister Michel Spiero, Defense Technical Assistant, Flávio Reis, Federal Police Delegate, and Felipe Monteiro, who founded the accusations, being heard.
According to representatives of the deputy, there were “serious procedural addictions and constitutional violations that directly compromise their fundamental rights to the contradictory and broad defense.”
The PL leader in the House, Sostenes Cavalcante (RJ), said in an interview that “the PL does not leave any of its soldiers,” supporting the parliamentarian. He also called Zambelli a “warrior wound soldier” and said he will fight for a “most voted woman in Brazil’s last election.”

The CCJ must analyze the cassation of Zambelli and give positive or negative opinion for the loss of mandate. Then the process will be submitted to the vote in the plenary of the House of Representatives. For the deputy to be actually deprived of his position, 257 parliamentarians must vote in favor.
Zambelli faces the process of loss of mandate due to his conviction, on May 14, for the invasion of the electronic system of the National Council of Justice. The Supreme Court (STF) sentence also determined that the congressman be arrested for ten years.
Zambelli left the country days after the decision and took refuge in Italy, a country in which he has nationality. Judge Alexandre de Moraes, of the Supreme Court, decreed the deputy’s pre -trial detention due to escape, the capture has not yet been fulfilled.
