Judge Ángel Hurtado, magistrate of the Supreme Court who has prosecuted the State Attorney General, has given the Prosecutor’s Office three days and the rest of the person personally pronounced regarding the request of the Professional and Independent Association of Prosecutors (APIF) to suspend him from his position provisionally once he dictates an oral trial opening order.
In a providence, the instructor of the cause, Ángel Hurtado, grants this period for all parties to allege what suits their right. It should be remembered that the popular accusation exercised by the APIF made that application after the appeal room considering that it personally promoted and coordinated the filtration on investigation for fiscal crimes against Alberto González Amador, the boyfriend of the president of the Community of Madrid, Isabel Díaz Ayuso.
In its brief, the Association maintains that the suspension is essential to guarantee the correct development of the process, while García Ortiz continued to be a State Attorney General in the act of the oral trial, he would be the hierarchical superior of the appointed prosecutor to intervene and, as such, he could give him orders.
Within the framework of the procedure, the magistrate has also agreed to lift the suspension of the processing of the cause that agreed on June 14. He made that decision until the resolution of the appeal resources filed against the car by which the processing of García Ortiz and the head of the Provincial Prosecutor’s Office of Madrid, Pilar Rodríguez, was agreed.
It was this Tuesday when the Appeal Chamber, made up of magistrates Andrés Palomo, Julián Sánchez Melgar and Eduardo de Porres, confirmed the processing of the State Attorney General, but filed the cause against Rodriguez when considering that there were no sufficient indications against him.
As for the latest proceedings, the Criminal Chamber of the High Court has dismissed the APIF appeal against the instructor’s car that denied several of the requested proceedings. The Association proposed that the Central Operational Unit of the Civil Guard determine whether numbers such as those of Pilar Sánchez Acera (Exasesora de Moncloa), Miguel Ángel Rodríguez (Chief of Cabinet of Isabel Díaz Ayuso), and several journalists.
He also asked that Hurtado require the head of the Fiscal Inspection, María Antonia Sanz Gaite, the three account files related to González Amador. The superior prosecutor of Madrid, Almudena Lastra, testified that there should be three files: one by the Provincial Prosecutor of Madrid, another by the Superior Prosecutor’s Office of Madrid, and another in the State Attorney General’s Office.
The Criminal Chamber shared the instructor’s criteria on the first request and argued that, in this case, the data of the investigated phone is not reliable, since it erased all its messages.
