Unemployment allowance is a monthly financial support for those who have lost their work in a involuntary way. However, in order to access this installment, there are several legal conditions that need to be met, and not all candidates meet the requirements.
Support intended for those who lost their jobs
According to Social Security, it is “a support paid in cash per month to unemployed people who are registered at the Employment Center”, acting as compensation for the loss of salary. This registration must be made at local employment services and is mandatory to start the process.
Access conditions
Fundamental criteria are: living in Portugal, being in a situation of involuntary unemployment, having the capacity and availability to work, as well as being registered at the area of residence employment. In addition, the subsidy request must be made within 90 days after the date of unemployment.
According to the same source, foreign citizens may benefit support, provided they have a valid residence title or authorization that allows you to enter into employment contracts. Refugees or people in a situation of apatridia may also access the subsidy, upon temporary protection title.
Specific rules and exceptions
There are also particular cases in which the worker may request the subsidy even though he was terminating the contract, namely when the decision results from situations of domestic violence, provided that he presents the status of victim.
Another important condition is the impossibility of working, paid or not, for the same company that dismissed the worker or to associated companies.
If the beneficiary exercises partial activity, as an independent worker or on behalf of others, he may be entitled to partial subsidy, provided that the income is below the value of the installment.
The warranty period
In order to access the subsidy, it is mandatory to comply with the so -called warranty period. This means having at least 360 days of social security discounts in the last 24 months before the unemployment date. In the case of teachers hired and also enrolled in the Caixa Geral of Retirement, the deadline is 540 days in the last 36 months.
When the worker does not gather the necessary days, he may, as an alternative, apply for the social unemployment allowance, provided that he meets the requirements established for this modality.
How the independent income is accounted for
The calculation for independent workers is done differently. It explains that the annual income corresponds to 70% of the total value of the services provided or 20% of the volume of business in production, sale of goods and hotel and restoration services in the previous year. These values can be considered to complete the warranty period.
