With two convictions, Zambelli must serve more than 15 years in prison

The federal deputy licensed Carla Zambelli (PL-SP) now accumulates two convictions in the STF (Federal Supreme Court)which together add up to more than 15 years in prison.

The crimes of illegal gun possession and illegal embarrassment with the use of a weapon, in an episode that occurred on the eve of the 2022 elections in São Paulo.

In the Virtual Plenary of the Supreme Court, the vote ended 9-2. Only ministers André Mendonça and Nunes Marques diverged from the rapporteur, Gilmar Mendes. Mendonça suggested the penalty of 8 months in an initial open regime.

Despite the conviction, Carla Zambelli’s lawyers can still submit appeals in the Supreme to try to reverse the conviction.

In May of this year, Zambelli had already been unanimously sentenced to 10 years in prison for invasion of the CNJ (National Council of Justice) systems. In this case, the case is already in res judicata, without the possibility of appeals.

In addition to the arrest, in this first conviction, the Supreme Court also determined the loss of the deputy’s mandate and the payment of a joint fine of R $ 2 million.

The investigation pointed out that they inserted false documents into the CNJ system, as an arrest warrant against STF Minister Alexandre de Moraes.

Extradition process

The deputy is now trapped in Italy. After the first conviction, he left Brazil and was arrested in Europe, where he awaits the completion of the extradition process.

The Brazilian government requested the return of the deputy, and the case is under analysis by the Italian court. Meanwhile, the defense claims political persecution and questions the speed of decisions.

A new hearing is scheduled for next Wednesday (27). Lawyers try to replace pre -trial detention with precautionary measures and claim that the deputy has weakened health.
