It approved, on Wednesday (27), a project that vetoes the granting of bail to accused of pedophilia-related crimes. The proposal was approved in a terminative way in the Constitution and Justice Commission () and, if there is no resources, will go directly to the House of Representatives, without the need for voting in plenary. The initiative aims to harden the legislation against sexual crimes involving children and adolescents, considering them “unenforceable”. The rapporteur of the bill, Senator (Union-AC), defended the measure, classifying the abuse and sexual exploitation of young people as a “cowardly crime”. “In addition, mostly, it is practiced by adults who have closer contact with the young or vulnerable, such as parents, tutors, caregivers, teachers, among others, which intensifies the severity of this conduct,” said the senator.

The proposal defines as unenforceable the crimes of corruption of minors, satisfaction of lust through the presence of children or adolescents, favoring prostitution or other form of sexual exploitation of children or adolescents. It also includes the dissemination of the rape scene when committed against vulnerable, the dissemination, acquisition, storage and possession of child pornography, as well as its sale or commercialization. Finally, it covers the simulation or induction of child pornography and the enticement of children and adolescents for sexual purposes.

Bittar explained the motivation behind the proposal: “We understand that any and all crime with sexual connotation committed against children, adolescents or vulnerable should be considered unenforceable, and the perpetrator must remain in prison throughout the trial, until he does not return to the criminal conduct.”

In addition to sexual crimes, the project also expands the list of heinous crimes, including embezzlement, fake data insertion in passive and active information systems and corruption.
