“Habeas corpus (presented by the defense of) is not appropriate for proof review or for questions that do not directly affect freedom of locomotion, such as the definition of competence without reflection on the right to come and go,” said the STJ minister, as published by the portal Brazil agency.

According to the Federal Police investigation, the player would have forced a deliberate yellow card during the match between Flamengo and Santos, played in November 2023, in Mané Garrincha, valid for the Brazilian Championship.

The conduct aimed to benefit gamblers, including his brother, Wander Pinto Junior, and his sister -in -law, Ludymilla Araújo Lima.

The same investigation made Bruno Henrique Defendant in sports court. The first disciplinary committee of the STJD will judge next Thursday (4), at 9am (Brasília), the case involving Bruno Henrique and four people by handling results involving sports bets. Learn below.

The Federal Police investigation and the complaint at the STJD

The complaint is the result of the information collected in the 107/2025 inquiry, which investigated the athlete of Flamengo for forcing a yellow card and benefits gamblers in the match between Flamengo and, for the Brazilian Championship of 2023.

At the time, there were only evidence of correlation between the abnormality detected in the BETs market and the yellow card applied to the player, without elements that demonstrated the causal relationship between the sports event and the unlawful action of jurisdiction. The scenario changed completely after the investigations by the Federal Police and the sharing of evidence with sports justice.

The investigation found that athlete Bruno Henrique forced the yellow card, as such conduct had been previously communicated to his brother, Wander Nunes Pinto Junior, through messages exchanged in a messaging application. According to the police authority, he would have deliberately acted to defraud event linked to that of 2023, by passing on privileged information to his brother Wander.

In possession of the information, Wander made bets on the eve of the match using his account and his wife on a betting platform. In addition, Bruno Henrique’s brother passed on the information to friends in order to also make bets, aiming to obtain improper advantage over the interests of betting operators.

In an STJD survey, the processing auditor, Maxwell Vieira determined the subpoena of nine people pointed out as suspicious accounts, as well as Bruno Henrique, to hold hearing by video conference. Most of the summons chose to exercise the right of silence. Nevertheless, the Federal Police’s final report has joined and concluded that the existence of indicative elements of the practice of fraud in sports competition and estelionate, due to the use of privileged information to obtain improper economic advantage, to the detriment of betting operators.

In addition to, the Attorney’s Office denounced four more amateur athletes: the player of the player of, Wander Nunes Pinto Junior, as well as Claudinei Vitor Mosquete Bassan, Andryl Sales Nascimento dos Reis and Douglas Ribeiro Pina Barcelos (all friends of Wander).

As a result, the group mobilized by Wander made bets specifically on Bruno Henrique’s card market, causing an atypical movement that even led some platforms to block payments.

Flamengo’s striker was framed in the articles:

  • Article 243: Deliberately act in a harmful way to the team that defends. Paragraph 1. If the infraction is committed upon payment or promise of any advantage, the penalty shall be suspended three hundred and sixty to twenty days and elimination in the case of recurrence, in addition to a fine, from R $ 100 to R $ 100 thousand.
  • Article 243-A: Act, contrary to sports ethics, in order to influence the outcome, proof or equivalent. Penalty: fine, from R $ 100 to R $ 100 thousand reais), and suspension of six to twelve matches, evidence or equivalent, whether practiced by athlete, even if alternate, coach, doctor or member of the coaching staff, or for a period of one hundred and eighty to three hundred and sixty days, if practiced by anyone. natural submitted to this code; In the case of recurrence, the penalty will be eliminated.

If the procedure is reached the intended result, the judging body may annul the departure, proof or equivalent, and the penalties will be a fine, from R $ 100 to R $ 100,000.00 (one hundred thousand reais), and suspension of twelve to twenty four matches, proof or equivalent, whether practiced by athlete, even if alternate, coach or member of the coaching staff, or for the seven hundred and twenty days, if practiced by any other natural person submitted to this Code; In the case of recurrence, the penalty will be eliminated.

The request of the Attorney’s Office is that the penalties be applied pursuant to article 184 of the CBJD, authorizing the cumulative application of the punishments provided for in the two reported articles. If judges do not understand by framing articles 243 and 243-A, the Attorney’s Office, in the alternative, requests the application of article 191, item III, by breach of article 65 of the General CBF Competition Regulation, which aims to prevent the manipulation of starter results.

Wander, Bruno Henrique’s brother, will respond to article 243-A (act, contrary to sports ethics, in order to influence the outcome, proof or equivalent).

Claudinei, Andryl and Douglas were reported for infringement to two articles:

  • Article 243-A of CBJD: Act, contrary to sports ethics, in order to influence the outcome, proof or equivalent).
  • Article 163 of CBJD: Who, in any case, competes for the infraction focuses on the penalties to it, to the extent of their participation.

Finally, due to the seriousness of the facts narrated, the Attorney’s Office calls for the expansion to comply with the penalties in the international level, as provided in Article 70.1 of the FIFA Disciplinary Code 2025.

It is worth remembering that FIFA’s disciplinary code provides, in cases of results manipulation, that the deadline for processing is extinguished in 10 years, shapes article 10.1, b.
