Ordinance extends export benefit in the face of tariff

Measure allows to extend for 1 year Drawback deadlines to Brazilian companies affected by the tariffs imposed by the United States

The government published, in an extra edition of DOU (Official Gazette) on Tuesday (2.SET.2025), a decree that regulates art. 10 of Provisional Measure No. 1,309, of 13.ago, allowing the exceptional extension of the deadlines for suspension of taxes in the regime of drawback suspension.

The decision reaches concession acts whose export commitments to the United States have been compromised by Brazilian products. Here is (PDF – 385 kB).

According to the text, the deadlines can be extended for another 1 year, provided that the act has already undergone previous extension, it has original validity that contains from 9.Jul.2025 to 31.Dec.2025 and is not finalized.

The Ordinance, signed by Tatiana Prazeres, Secretary of Foreign Trade of the Ministry of Development, Industry, Commerce and Services, also includes integral manufacturers that produce inputs for exporting companies, provided the final destination is the US market. To obtain the benefit, companies will need to prove that the commercial intention to export existed before 13.2025, through contracts, invoices or business proposals.

The request for extension must be filed in the Integrated Foreign Trade System (SISCOMEX), accompanied by the required documentation. Among the conditions is the obligation to declare that the products are not intended for use in civil aircraft, when framed in specific restrictions on the US executive order of 30.Jul.2025.

The measure seeks to give the Brazilian exporters breathtaking in the face of the barriers imposed by the US and to prevent them from being penalized for breaking export commitments because of external factors.

The tariff imposed by the government of (Republican Party) came into force in 6.ago. The US President determined a 50% rate on Brazilian imports-an overall rate of 10% added to an additional 40% charge.

Not all items were included in the tariff. 694 Brazilian products were left out, equivalent to 43% of the total exported to the US in 2024.
