This Tuesday, September 9, 2025, the minister must present his vote in the scammers of. It is a historical moment of Brazilian democracy, and the culmination of the biography of one of the most important ministers in the history of the Federal Supreme Court.
I wrote “important” and made a point of not adding “controversial”, as is often done when it comes to Xandão. The adjective would be up to the arguments of the critics and the defenders of Moraes there were factual lashes of at least similar orders.
There are no deducted those who criticize Moraes because they support the crimes he judges, also discounted those who hope to make money or climb their career by giving them credit, the legitimate criticism of Alexandre de Moraes are only those that could be expected in such a bad judgment.
If, due to the size of the crime, this is the biggest judgment in the history of, it is also one of the most trivial: the evidence against the accused is overwhelming. Moraes was not consecrated for unraveling legal subtleties, but for not ignoring crystalline facts for fear of black kid or desire to visit Disney.
I even make a point of defending the accused’s lawyers: Yes, their arguments last week were fragile and often embarrassing. But I have no doubt that if there were good arguments for acquittal, the defenses would have been able to quote them. If a single fact had to be favorable to the accused, the defenses would have been able to bring him to light.
As the British magazine The Economist well acknowledged, Moraes’s performance was according to Brazilian law, which gives great powers to the Supreme Court. In the formula created by political scientists Carlos Pereira and Marcus Mello, the 88 constituents created a “strong dog collar” when they put the STF to oversee the Presidency of the Republic.
But it is obvious that the STF’s protagonism in combating coup has shown how our other institutions failed in their respective tasks. Much of what the STF did should have been done by the Attorney General’s Office, which, however, was occupied by Augusto Aras, always docile before Jair. Much of what the STF did should have been done by the National Congress, but Bolsonaro bought parliamentarians with the end of Lava Jato and the creation of the secret budget.
Compare the performance of the STF and Brazilian congressmen last week. Is it for this congress, where the thieves have combined the scammers to make it impossible to arrest politicians, that the Supreme Court should have delegated the fight against the coup? Who in the center would hold on, I no longer say a magnitsky sanction, but a rude tweet of Trump that was?
In the fight against coup, the Supreme Court did not have an excess of protagonism. The other Brazilian institutions, more easily capturable for varied thieves and directisms, are omitted.
Anyway, even if Congress shapes us, Moraes on Tuesday should be proud of the refounders of Brazilian democracy who made the 1988 Constitution. Most of the first class of the Supreme Court should do the same by Friday. In recent times, we have had much worse weeks.
