Former President Jair Bolsonaro’s lawyers told reporters, leaving the trial at the Supreme Court (STF) on Tuesday (9), who saw a positive point today in the vote of Minister Flávio Dino, who makes up the first class of the Supreme Court.
For lawyers Celso Vilardi and Paulo Amador Cunha Bueno, Dino opened a divergence regarding the vote of the rapporteur Alexandre de Moraes. Both voted for the conviction of Bolsonaro and other defendants of Nucleus 1. The case in trial is the attempted coup d’état that occurred between the end of 2022 and January 2023, following Bolsonaro’s defeat at the polls to President Luiz Inacio Lula da Silva.
In the vote, Minister Flávio Dino argued that there are different levels of culpability in the process. Therefore, he argued that the dosimetry of penalties must also be different.
However, Dino, when he made this statement, referred to defendants Paulo Sérgio, Augusto Heleno and Alexandre Ramagem who, according to him, had a minor participation and not to former President Jair Bolsonaro.
Regarding the former president, Dino accompanied the vote of Moraes who considers Bolsonaro leader of the criminal organization that planned the coup.
