Senator () said on Tuesday (9) that he will ask, along with other opposition parliamentarians, that the Supreme Court (STF) suspend and annul the trial of his father, the former president (PL), by the coup plot based on accusations made by Eduardo Tagliaferro, former advisor of the minister.
For this, he wants to use a precedent of Operation Lava Jato that was used to nullify the processes that condemned the current president, Luiz Inacio da Silva (PT). Flávio said he will send a letter to the STF with tagliaferro documents to show that Moraes would have procedural.
The idea is to use the same procedure used by Lula, after the Intercept site that showed both combining actions and strategies for investigation.

When Tagliaferro made the accusations last week, the minister denied irregularities and said that his actions in this and other investigations were official.
In 2024 he revealed that Moraes acted outside the rite in investigations of the fake news inquiry, adopting attitudes that, in a normal process, are attributions of the Federal Police (the investigative body) and the Attorney General’s Office (the body that makes the accusation).
The reports were based on Tagliaferro conversations and showed that Moraes’s Office ordered by messages and unofficially the production of reports to support decisions of the minister himself against pockets.
Dialogues to which the report had access shows how the disinformation sector, chaired at the time by Moraes, was used as an investigative arm of the minister’s office in the Supreme.

This Tuesday, Moraes, who is rapporteur of the coup plot inquiry, voted to condemn the former president for leading the attempt to overthrow the Brazilian state.
Prints and documents presented by Tagliaferro to the committee also show that an operation against conversation scholarship entrepreneurs in a Whatsapp group was based on only one report from the Portal Metrópoles – as he revealed the Sheetat the time.
The former advisor says that the technical report that supported that operation, dated August 22, 2022 (one day before the operation), was actually produced on the 28th of that month, six days later.
The date, he said, was fraudulent to give the impression that the operation authorized by Moraes against the Bolsonarist entrepreneurs was not only based on the report.
Flávio Bolsonaro wants to use these documents to request the suspension of Bolsonaro’s judgment in the Supreme Court, and for that presented on Tuesday a lawyer’s opinion.
The document states that many data is confidential, and some are not possible to prove, but compare the situation with Operation Spoofing, instituted after the Intercept site reveals, in 2019, the messages between Moro and Deltan.
According to the understanding of the law, the two cases incur in “situations in which the documents presented originated in alleged criminal practice and encompass data of a confidential nature.”
This is because both the messages and the documents presented by Tagliaferro were not the result of police investigation, but leakage.
“An institutionally adequate solution would be to refer the material to the competent court, so that it manages access and sharing, reconciling the preservation of confidentiality with the usefulness of content for procedural or investigative purposes,” says the opinion.
Flávio Bolsonaro said he will send all the documents to the Supreme.

In 2023, STF Minister Dias Toffoli annulled Lava Jato evidence. The decision was a consequence of Operation Spoofing triggered after the Intercept revealed the messages that showed the collaboration between Moro and Deltan during the investigation.
Earlier, in 2021, the former judge had already been considered by the STF as partial to judge Lula, due to his relationship with the prosecutor during the investigation, and all his acts were canceled.
The sentence of the petista at that point, however, had already been annulled. But the position of the Supreme made any other sentence arising from that material to lose validity.
