The rapporteur, Minister Alexandre de Moraes, was accompanied by Flávio Dino, Cármen Lúcia and Cristiano Zanin. Luiz Fux voted for acquittal. The final score was 4 to 1.

Conviction

Bolsonaro was convicted of the following crimes:

  • Armed criminal organization;
  • attempted violent abolition of the Democratic Rule of Law;
  • Damage qualified by violence and serious threat; and
  • deterioration of listed assets.

Remember the case

On January 8, 2023, protesters from various cities and the camp in front of the Army General invaded the National Congress, the Planalto Palace and the STF. Works, structures and historical pieces were destroyed.

Former President Jair Bolsonaro was in the United States when the attacks occurred, but was already in the sights of the Federal Police as a possible mentor of a coup plan.

The findings advanced with the denunciation of Lieutenant Colonel Mauro Cid, former Bolsonaro orders. He reported meetings of the then president with ministers, ambassadors and military chiefs before the 2022 elections, in which Bolsonaro put the credibility of the ballot box.

In the second round, the PRF would have been mobilized to hinder voters’ access in cities more favorable to President Luiz Inacio Lula da Silva (PT). Following the petista’s diplomation in December, vandals burned cars and buses and tried to invade the PF headquarters in Brasilia, and days later a bomb was found near the capital’s airport.

Still in December, investigations pointed out the elaboration of a scammer draft and the “yellow-green dagger” plan, which provided for the murders of Lula, Alckmin and Moraes. The PF survey was completed in November 2024.

Bolsonaro and 36 other allies were indicted and denounced by the PGR, which divided them into five nuclei. The central core, led by Bolsonaro, would have planned to prevent Lula’s possession. The complaint was accepted by the Supreme Court, and the defendants began to respond to a criminal action.
