Defense of Augusto Heleno says he will ‘fight to the end’ to prove innocence

The defense of General Augusto Heleno said on Friday, 12, that he will “fight to the end” to prove the innocence of former Minister of Institutional Security Office (GSI), sentenced to 21 years in prison by the Supreme Court (STF) under the 2668 criminal action.

In a note signed by lawyer Matheus Mayer Milanez, the lawyers reported that they will appeal the decision through embargoes of declaration, pointing out omissions and alleged failures in the analysis of the evidence.

“We will seek the necessary clarification through embargoes of declaration, which will bring to light these points not approached or not taken into consideration at the time of the trial,” says the statement.

The defense also criticizes the grounds adopted by the ministers of the First Class of the Supreme Court, stating that there were “generic allegations” in the condemnation of Heleno, rather than robust evidence.

“The nullities presented were not properly faced, and central points were omitted in the votes. There was also no detailed analysis of the evidence produced throughout the procedural instruction and presented in oral support.”

The lawyers also claim that there is no evidence against the general and that he would have been included in the coup plot only for his proximity to former President Jair Bolsonaro.

“The testimony of the defense, prosecution and the collaborating defendant unequivocally evidenced the non-participation or knowledge of the defendant about any kind of ‘coup contract’. On the contrary, they demonstrated that what was tried was to insert him in this alleged scheme, due to his position and his personal relationship with former president Bolsonaro.”

In addition to Augusto Heleno’s legal team, former President Jair Bolsonaro’s defense also spoke out against sentences, classifying them as “excessive” and “disproportionate”.

“The defense understands that the penalties set are absurdly excessive and disproportionate and, after analyzing the terms of the judgment, will file the appropriate appeals, including the international level,” says the note.

Voting in the Supreme Court

The first class of the Supreme Court formed a majority of 4 to 1 for the conviction of the members of the main core of the coup plot. The conviction voted for ministers Alexandre de Moraes -who is also a rapporteur of the criminal action -Flávio Dino, Cármen Lúcia and Cristiano Zanin. The only divergent vote was that of Minister Luiz Fux, who understood that there are not enough elements to characterize attempted coup.

Jair Bolsonaro: He was sentenced to 27 years and 3 months in prison at the trial of the coup plot. It is the first time in the history of Brazil that a former president is convicted of attempted coup.

Alexandre Ramagem: Former director of the Brazilian Intelligence Agency (Abin) and federal deputy (PL-RJ), was sentenced to 16 years and 1 month in prison for attempted coup. The ministers also decided to lose their parliamentary mandate.

Paulo Sérgio Nogueira: Former Defense Minister in the Bolsonaro government, he was sentenced to 19 years in prison, 16 years and 11 months of imprisonment and 2 years and 1 month of detention for coup and other crimes.

AUGUSTO HELENO:The general was sentenced to 21 years in prison, of 18 years and 11 months of imprisonment and 2 years and 1 month of detention for attempted coup.

Almir Garnier: Former Navy Commander, he received a sentence of 24 years in prison, being 6 months of imprisonment and 2 years and 6 months of detention for coup attempt.

Anderson Torres: Former Minister of Justice and former DF Secretary of Public Security, he was sentenced to 24 years in prison, 21 years and 6 months of imprisonment and 2 years and 6 months of detention.

Walter Braga Netto: The general was sentenced to 26 years in prison for attempted coup.
