The federal deputy (PL-SC) presented a project of legislative decree to support normative instruction of the creation of the Brazilian real estate registration, nicknamed “CPF of real estate”, on the grounds that it establishes a “centralized patrimonial surveillance structure”.
The normative instruction was published on August 18 and deals with the adoption of the Brazilian Real Estate Register and the sharing of information through the National Territorial Information Management System by the Note and Registration Notary’s Offices.
According to the recipe, the system will be tested in 2026 and is. The intention is that the tax authorities have access to information on real estate transactions provided by the notary’s offices that will allow a kind of “reference value” of real estate and thus fight tax evasion.
Zanatta, in his legislative decree project, criticizes revenue and states that the norm is “true centralized heritage surveillance structure, devoid of specific legal authorization, facing fundamental rights and guarantees ensured by the Constitution.”
The parliamentarian also says that the instruction creates “presumptive mechanisms for real estate assessment and intersection of equity data, which, besides not provided by law, have direct tax impact potential, including for ITCMD, IPTU and capital gain purposes.”
The circulation of information on tax increases with the creation of the “CPF of real estate” led the revenue to publish, last Tuesday (9), a clarification note.
“The Brazilian Real Estate Registration – CIB, provided for in the tax reform, is an inventory of real estate, powered by data from municipalities and notaries among others,” says the message.
“The purpose of CIB is to provide Brazil with a single real estate register, generating legal certainty to owners, acquirers and sellers, related to property operations under the value added tax – VAT Dual, from 2027,” says the tax authorities.
