The 3rd Panel of the Federal Regional Court of the 4th Region (TRF-4) ordered on Tuesday (16) former President Jair Bolsonaro (PL) and the Union to pay R $ 1 million in compensation for collective moral damages. The court stressed that the weight of the speeches expands because they were made in official broadcasts, when Bolsonaro held the maximum position of the Republic. In this context, the magistrates understood that the episode is not merely rhetorical excess, but discriminatory practice with social repercussion.

TRF-4’s decision creates a relevant precedent in legally recognizing the concept of recreational racism, consolidating the understanding that mood-pranmed offenses also generate responsibility.
For Bolsonaro, the conviction expands its judicial liability, which already includes criminal and civil proceedings arising from its political action.
