Representatives of subtitles that have 27 ministers in the Lula administration helped the proposal, including the PT; The text goes to the Senate
The PEC (Proposal for Amendment to the Constitution) of the Armage () this Thursday (16.Set.2025) with the support, in the 1st round, of 232 Deputies (in a score of 353 x 134) of parties who have ministers on the President’s Esplanade (PT). In the 2nd shift, they were 224 favorable votes of affiliates to subtitles with representatives in the government (in a score of 344 x 133). Now the text goes to the Senate.
The proposal makes the ways almost voids to judicially punish a congressman. Of the 38 ministries, 27 are occupied by parties who have deputies who voted in favor of the measure. Here’s how they voted:
In 1st round:
- MDB: 35 votes in favor;
- Union Brazil: 53 votes in favor;
- PP: 46 votes in favor;
- Republicans: 42 votes in favor;
- PSD: 25 votes in favor;
- PDT: 10 votes in favor;
- PT: 12 votes in favor;
- PSB: 9 votes in favor.
In 2nd shift:
- MDB: 32;
- Union Brazil: 52;
- PP: 45;
- Republicans: 43;
- PSD: 24;
- PT: 10;
- PDT: 9;
- PSB: 9;
The PT-PV and PC Federation of B had advised against. The government released the bench, that is, it did not define how deputies should vote.
PEC of Armage
The text states that, in order for a congressman to be arrested or processed, their houses must authorize by simple majority. The deadline for this decision will be 90 days from the determination of justice.
In the House, the simple majority corresponds to 257 favorable votes from the total of 513 congressmen who make up the house. In the Senate, at least 41 votes of the 81 senators would be required to authorize judicial measures against their members.
Deputies and senators can only be arrested in the act for unenforceable crimes in the Constitution, such as racism and “terrorism”. Even in the act, the maintenance or continuity of the arrest and the investigation undergoes the decision of the house, which will have to be made in this case in 24 hours.
The new text also extends the privileged forum in the Supreme Court (STF) to the national presidents of political parties with representation in Congress.
The proposal of amendment to Constitution 3 of 2021, called PEC of the PREROGATIVES or PEC of Armage, was led by the former mayor (PP-AL) in 2021. It is authored by the current Minister of Tourism, (União Brasil-PA).
At the time, Lira articulated the proposal on the grounds of preventing other deputies from being arrested by the Supreme Court, as it was with (without party-RJ). This is because, in practice, the proposal makes the ways almost null and null and judicially punish a congressman.
