The determination of Minister Flávio Dino of the Federal Supreme Court (STF) of suspending transfers to nine municipalities was based on evidence of irregularities involving amendments sent by a group of 25 congressmen and former consisting. The list includes names such as Deputy Pastor Marco Feliciano (PL-SP), former Minister of Culture Marcelo Calero (PSD-RJ) and current Minister of the Federal Court of Audit (TCU) Jonathan de Jesus, both former parliamentarians. Wanted, Jonathan and Feliciano did not respond. Calero, in turn, said that the execution of the money was done regularly.
Reports of the Comptroller General of the Union (CGU) that supported Dino’s decision pointed out weaknesses in the transfer of funds indicated by politicians through the so-called Pix Amendments, a modality in which money falls straight to the municipalities account, without being linked to a specific work or service. Among the suspicions cited by the agency are lack of transparency, paralyzed services or not even started, overpricing and lack of proof that the money was actually reversed to the population.
Dino determined on Monday that the information gathered by CGU is sent to the Federal Police, to investigate the misuse of public appeal. In the case of funds sent by parliamentarians currently in the mandate, however, a possible criminal action may depend on the endorsement of the Congress itself in case the proposal of amendment to the Constitution (PEC) of the armor, approved yesterday in the House, also passes through the Senate. The initiative has been treated as a response from the legislature to the STF offensive involving the amendments.
One of the cases in which the CGU pointed to “serious irregularity” involves resources sent by Jonathan de Jesus, when he was deputy of the Republicans, and his father, Senator Mecias de Jesus (Republicans-RR), to Iracema and São Luiz do Anauá, in Roraima.
In the case of Iracema, benefited with R $ 3.8 million Jonathan, the audit pointed out that despite the sending of resources between 2020 and 2021, the works planned such as the construction of a city portal and popular houses, did not leave the paper. “Workers were not seen during the visit and the city engineer confirmed that there are no activities in progress,” said the CGU when inspecting where the portal should be erected.
In Iracema, the CGU also identified that a dental mobile unit was acquired for a 37% higher than the market price, and was, at the time of inspection, without gloves, masks or any material that indicated recent use.

In relation to São Luiz do Anauá, which received R $ 3.2 million via amendments from Jonathan and another R $ 2 million, the audit pointed to deviation of purpose in the use of a Van acquired with Jonathan’s amendment resources. Instead of serving health professionals, it was used to transport participants of a religious event. The CGU technicians also identified that ambulances were delivered in disagreement with the required in the bidding (without sliding side door).
Sought, Mecias stated that it supports the inspection of resources, which has the execution under the responsibility of the municipalities. “The mandate of Senator Mecias reaffirms his commitment to continuing to allocate parliamentary amendments to all the municipalities of Roraima, always seeking the development and well-being of the population, and supports the strict supervision of the application of these resources,” said the senator’s office.

In Rio de Janeiro, where the amendments were also blocked, part of the appeal was sent by former federal deputy Marcelo Calero, who was Minister of Culture in the government of Michel Temer. The CGU stressed that, in the case of Calero, he was not only responsible for sending the funds, but also for executing them, since after leaving the mandate took over the Capital’s Secretariat of Culture.
One of its amendments, of R $ 7 million, was intended for the “execution of funds by the Municipal Secretariat of Culture for preservation and expansion actions of the cultural space network”. The CGU audit, however, pointed out an overpricing of R $ 201.8 thousand in the acquisition of acoustic doors for the theaters Ipanema and Ziembinski.
According to the former parliamentarian, the irregularities pointed out “have been widely clarified during the audit, in which it was shown there was no irregularity in the use of these resources.” “It is noteworthy that the price formation of the items strictly followed the official system of the City Hall (SCO-Rio Table), prepared by the Getulio Vargas Foundation, as established by Decree 49.264 of August 12, 2021. Consulted again, FGV ratified the values practiced by the Rio City Hall,” he says in a statement.

In the list of municipalities that had the suspended transfers, which received more funds via amendments Pix was Carapicuíba, in the metropolitan region of São Paulo. Among the parliamentarians responsible for supplying the city’s cashier are Federal Deputy Marco Feliciano (Republicans-PB) and former deputy Alexandre Frota (PDT-SP), today Secretary of Institutional Relations of Cotia, also in Greater São Paulo.
In one case, auditors failed to identify how $ 7.7 million from a $ 8 million amendment were spent. According to the auditors, the city did not present documents to prove where the money was after it was deposited in an account used for current expenses, such as salaries of servers, consumer accounts and general expenses.
According to the Work Plan presented by the Municipality, the resources should be spent on paving, purchases of ballistic vests and the acquisition of basic baskets, among other items. In practice, however, by including money in a common account, it was not possible to know if the amendment was diverted to another purpose.

In a statement, federal deputy Marco Feliciano denied irregularities and stated that “no work plan of amendments indicated by the deputy were failed.” Globo sought out former deputy Alexandre Frota, but got no return.
