The rapporteur of the proposal to reduce penalties to those involved in the acts of January 8, Deputy Paulinho da Força (Solidarity-SP), will hear on Monday governing deputies and opposition to the construction of the text as an alternative to amnesty. “I already warned that I won’t be able to do this. Who can help Bolsonaro are his lawyers, not me,” said Paulinho.
One possibility is that the text, not yet closed, foresees smaller penalties than applied today to crimes of attempted coup (4 to 12 years in prison) and violent abolition of the Democratic Rule of Law (4 to 8 years in prison). The hypothesis of reducing punishments for the crime of deterioration of equity is also discussed.
The project was renamed by the rapporteur as PL of Dosimetry, attempted to set aside the amnesty PL nickname. The text was debated at a meeting last week at former President Michel Temer’s house in Sao Paulo. In addition to Paulinho, Deputy Aécio Neves (PSDB-MG) also participated, while the mayor, Hugo Motta (Republicans-PB), accompanied the meeting remotely.

According to the rapporteur, the project will not treat “individually” from situations such as Bolsonaro’s. If you propose the reduction of penalties, however, the benefit will extend to those who have already been convicted of crimes changing, because criminal law may retroact for the benefit of the defendants. This application is not automatic: it needs to be requested by the defenses and defined by the judges of each action. That is, in the case of the coup plot, the Federal Supreme Court.
