Those responsible for Social Security on Monday held a new meeting with entrepreneurs and unions within the framework of the social dialogue table in pensions. In this meeting, according to knowledgeable sources of the content of these conversations, government representatives have opened to study several improvements in the decree they prepare to give a new regulation to (the one in which the already retired worker decides to return to work partially for a while and compatible the salary with a part of the pension). Among these improvements, the Sopesa Ministry apply a slight increase in the pensions of those workers who would have retired in advance (with their pension cut) involuntarily. That is, after being fired.
In the first drafts to regulate this withdrawal modality, it was specified that the contributions carried out by retirees who partially return to work activity would not count on improving pensions or to increase accessories for delaying retirement. The unions claim, on the contrary, that the improvement of the benefit (which would come from recalculating the regulatory base) could affect all those who welcome flexible retirement. At the moment, always according to the sources of the negotiation consulted, Social Security is only open to improve the provision of forced early retirees.
The legal text, which runs in parallel to the negotiating table, has already gone through a public hearing, where it has been submitted to citizen allegations. Now in Social Security they must assess these contributions, as well as those of entrepreneurs and unions. The commitment is to present a draft of the Royal Decree in which this retirement modality will be regulated at an upcoming meeting of the Social Dialogue Board on pensions.
The Department headed Elma Saiz will carry the final articulated text, with the contributions that include, to the State Council and subsequently to the Council of Ministers. Once this approves, it will be published in the Official State Gazette. In the beginning it was planned that the new conditions of flexible retirement (it seems that it will recover that traditional name, although in one of the drafts it was called reversible) enter into force three months after its publication in the BOE.
Change in the day
In addition to a possible improvement of the pensions of the forced early retirees, those responsible for social security would also have been shown on Monday willing to study a change in the minimum percentage of the day that retirees who return to work must perform. The last draft of Royal Decree set a partiality fork for these jobs between 40% and 80%.
From there, if the retiree day that returns to work was between 60% and 80% of the ordinary full day, it would receive the improved proportional pension in 20%. If it returns to a day between 40% and 60% of the full day, the improvement of the resulting pension during this compatibility would be only 10%. However, the unions consider that these workers should be able to make days of less than 40% of a full -time employment and this is what they could now rethink from social security.
Likewise, the centrals demand that the percentage of 10% or 20% of the pension increase during the time in which a job is compatible and the collection of part of the benefit.
In the same way, and always according to the sources of the negotiation, the Executive has also been willing to analyze the requirements that were intended to demand those already retired people who decide (the current regulation of flexible retirement only allows it if they return to work on behalf of others). The initial draft did allow that autonomous work, but with a limitation: not having been registered in the special regime of this group (reta) during the five years prior to retirement.
For this group, an improvement of the 20%pension was raised, which these busy could make it compatible with their income as an autonomous while the flexible retirement will last. However, the unions have asked that, if the pension improvement percentages for self -employed workers will finally increase, the same is applied to self -employed.
