Part of the draft amendment to the Constitution of the Slovak Republic, which emphasizes the sovereignty of Slovakia on basic cultural-ethical issues, may affect the relationship of national law to the European Union law and the international obligation of the Slovak Republic. The Slovak Bar Association (SAK) pointed out this in connection with the draft amendment to the Constitution of the Slovak Republic, which is currently in the National Council of the Slovak Republic in the second reading. “The Slovak Bar Association considers it essential for the Slovak Republic to maintain loyalty to the law of the European Union and consistently respect its international obligations, especially in the field of human rights and fundamental freedoms.These principles are the basis of the rule of law and the prerequisite for the credibility of the Slovak Republic in European and international space, ” Sak appeals.
According to the Chamber, the proposed changes to the Constitution, it is necessary to consistently take into account their possible effects not only on national law, but also to Slovakia’s obligations arising from EU membership and international contracts.
According to the Chamber, a significant part of the experts draws attention to the risk of an unclear or incorrect interpretation that could potentially lead to the selective questioning of the binding of EU law and international law. “Other experts point out that these risks exist, but are well eliminated while maintaining the functionality of the free and independent Constitutional Court of the Slovak Republic.
Added that Changes in the State’s basic law with a potential impact on the human rights protection system require a thorough analysis, clear justification and ideally the widest possible professional and social consensus.
According to the proposal, two genders – a man and a woman – are to be anchored in the Constitution. There is also a guarantee of equality between men and women in remuneration for work. The Constitutional Act is also intended to regulate the adoption of children and the educational process. At the same time, the sovereignty of Slovakia in value and cultural-ethical issues should be achieved, As regards the protection of life and human dignity, private and family life, marriage, parenting and family, culture and language, as well as related things, especially in the field of health, education and training.
In the National Council (NR) of the Slovak Republic, a vote on the government amendment of the Constitution will certainly take place on Thursday at 5 pm. This was announced by Prime Minister Robert Fico (Smer-SD) at a press conference. He thinks there is no reason to postpone the vote. “It will certainly be voted today at 5 pm.
