It condemned a DJ known as “MC Rafaelzin” (featured photo) to pay $ 10,000 for moral damages to one. The sentence was issued on Monday (9/29).
Jamerson Cunha Júnior was filmed by the artist while working in an area near the JK bridge in October 2023. At the time, the rapper asked the merchant “how much it cost to punch him”, making an infamous pun with the price of the paçoca sold in the carrocinha.
Rafael de Souza Silva recorded with a cell phone the moment when he approached the seller and approached him.
In the images, DJ Rafaelzin, simulating that he would buy an acai berry, asked, “Is there acai there, man? Is there? Has paçoca, partner? How much is to punch there?”. Soon after, the DJ laughs and leaves the merchant astonished, without action. In a short time, the video went viral.

The video was published in the defendant’s profiles, with over 20,000 followers, as well as replicated in other accounts on social networks, reaching numerous views.
In the process, the merchant’s defense stated that the dissemination of the video was not authorized, that he suffered public humiliation and that his image and honor were injured.
The judge of the case understood that the defendant, vexatiously, registered and disclosed in social networks content involving the image of the victim, without consent, in humiliating and derogatory context.
“The recording and public disclosure highlight the practice of unlawful act, able to give rise to the duty to indemnify,” said the magistrate.
Lawyer Renato Araújo Júnior, who defends the seller and sued the DJ for moral damages, said he considered the fair. “We proved in the process that occurred violation of the honor and image of our client, the defendant registered and disclosed in his social networks content involving image, without consent, in humiliating, vexatious and derogatory context, the condemnation besides the arbitrated value is pedagogical.”
