In his decision, Moraes justified that the penalty “must be served in progressive regime, allowing the sentenced, provided that the objective and subjective legal requirements are present in its entirety, access to less strict regimes”. “In the present hypothesis, all the legal requirements required for the progression of the sentenced to the open regime of fulfillment of his deprivation of liberty,” wrote the minister.
The former deputy got the remission of 389 days of the sentence, slaughtered from the proof of study and work activities in the chain, and also paid the corrected fine of $ 271,000 for violating the electronic anklet while under house arrest.
Daniel Silveira was sentenced by the Supreme Court to eight years and nine months in prison for defending undemocratic guidelines, such as the dismissal of court ministers and the military dictatorship. In a video published on social networks in February 2021, he attacked and offended ministers, spoke of giving a “beating” on the magistrates, defended the 1964 military coup and the AI-5 (harder act of dictatorship).
The trial was concluded in April 2022, but Daniel Silveira did not begin to serve the sentence immediately because the former president (PL) issued a decree to forgive the conviction. The pardon ended up annulled by the Supreme Court. Until September 16, the date of issuing the most recent sentence certificate, it is reported that the former deputy served four years, one month and 26 days of the sentence.
