According to the request of the Senate, with the consent of the presidency of the House, the veto of President Luiz Inacio Lula da Silva (PT) to the bill that increases the number of deputies still remains pending appreciation by parliamentarians. The situation would prevent the application of the new rules as early as 2026.
In the injunction, Fux noted that the legislative process on the subject did not end in the National Congress and that, just over a year from the general elections, it is necessary to have “clarity regarding the number of seats for each state”, with the aim of avoiding legal insecurity.

According to the last IBGE census, held in 2022, seven states lost population and others won. Because of this, there would be the redistribution of chairs in the House.
However, to prevent states from losing representatives, the proposal approved by the two houses created 18 new chairs in the House of Representatives, leaving the current 513 to 531.
The new vacancies would be allocated between nine states, keeping unchanged the current representation of all federative entities.
The STF’s decision represents a relief to the congressmen, since the Court had signed the understanding that if the Legislature did not decide on the subject, the TSE (Superior Electoral Court) would remain the assignment to redistribute the vacancies.
