Son who stole the father’s trade should not be punished; See what the law says

A man called the Military Police to denounce a theft to his establishment in Curitiba, on Sunday (5), and eventually found out that one of the authors was his own son. The case brings up a particularity of the Brazilian criminal law.

Although theft crimes are punishable, the relationship of kinship between them triggers a exemption of penalty, legally known as “absolute deletions”which prevents the application of sanction to the young.

This legal determination is based on the Article 181 of the Penal Codewhich establishes the absolute criminal immunity. According to the law, it is exempt from penalty who commits a crime against equity to the detriment of ascendant or descendant. This rule aims to preserve family harmony.

However, this exemption does not apply crimes committed with the use of serious threat or violence to the personsuch as theft or extortion.

Remember Case

On Sunday (5), the Paraná Military Police detained three individuals suspected of stealing a commercial establishment in Londrina.

After the detention, the local owner found that one of the individuals involved was his son.

According to the Military Police, the man contacted the Operations Center and reported that three men would be practicing theft in commerce on Jamil Scaff Avenue.

The victim was watching the trio with the support of security cameras. Upon arriving at the scene, the police held the arrest of those involved.

. Police also confiscated meat and drinks that had been stolen by the group.
